May 13 declared a non-working holiday

You can no longer use work as a reason not to vote, since Election Day, May 13, has been named a special non-working holiday.

President Benigno Aquino III on Tuesday signed Proclamation No. 571, s. 2013, which  declares May 13 a special public holiday.

More than 52 million Filipinos are registered voters for the 2013 national and local elections, Commission on Elections data show.

A total of 18,050 elective seats are at stake. These include 12 senators to replace those whose six-year terms will expire this year.

Also up for grabs are legislative and executive positions in the country's 80 provinces, 143 cities and 14,091 municipalities.

"The President wishes to enable the Filipino people to exercise their right to suffrage," Palace spokesperson Edwin Lacierda said.

"We enjoin all eligible to use this non-working holiday to participate in the electoral process that forms the bedrock of our democracy," he added.

Under the Labor department's pay rules the following shall apply on special non-working holidays:

"a. If the day is unworked, the 'no work, no pay' principle shall apply unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day even if the day is unworked.

b. If worked, the employee shall be paid an additional 30 percent of the daily rate of 100 percent on the first eight hours of work. In excess of eight hours, he/she shall be paid an additional 30 percent of the hourly rate on said day.

c. If the day falls on the employee's rest day and is worked, he/she shall be paid an additional 50 percent of the daily rate of 100 percent on the first eight hours of work. In excess of eight hours, he/she shall be paid an additional 30 percent of the hourly rate."
